TERMS OF USE

of the information and analytical system for the search and processing of information in the field of business and other types of activity "YOUCONTROL.MARKET"

Access to the information and analytical system for the search and processing of information in the field of business and other types of activity "YOUCONTROL.MARKET" (hereinafter referred to as the "YC.MARKET" System) provides the ability to obtain information (including summary information) and the corresponding analytical data in the field of business and other types of activity in Ukraine.

Access to the "YC.MARKET" System through the website https://youcontrol.market is provided following completion of the registration and authorization procedures. Registration in the "YC.MARKET" System is carried out by filling in the registration forms in the "YC.MARKET" System. A message enabling access to the "YC.MARKET" System for further authorization is sent to the email address specified during registration. Access to the "YC.MARKET" System is carried out after the Licensee is identified by authorization – entering the login and password of the Licensee in the "YC.MARKET" System, or using other login methods provided in the "YC.MARKET" System.

The Licensee may use the data, including personal data, of its account in the "YC.MARKET" System for expedited registration and logging into an account in another Software Product of the Licensor or of persons affiliated with the Licensor, where such functionality is provided by the relevant Software Product. For this purpose, the Licensor may process the relevant data and transfer them to another Software Product of the Licensor or of persons affiliated with the Licensor.

The ability to properly access the "YC.MARKET" System via the website: https://youcontrol.market and obtain the necessary information through it is provided only if using the current versions of internet browsers that receive official security updates, compatibility fixes and technical support.

Automated Workstation (AWS) means an end-user computing device (computer, tablet, smartphone, etc.), within a single browser on that device, through which the Licensee currently accesses the "YC.MARKET" System. Simultaneous current access to the "YC.MARKET" System from multiple devices and/or multiple internet browsers installed on the same device is excluded.

During the term of the right to use the "YC.MARKET" System, the Licensee may:

  • • access the "YC.MARKET" System in the manner provided by the Licensor;
  • • obtain information (including summary information) and the corresponding analytical data through the "YC.MARKET" System and use them to support its activities;
  • • form and/or distribute in the section of the "YC.MARKET" System intended for the distribution of information by users of the "YC.MARKET" System, information that reflects its own thoughts, beliefs, judgments, assessment of certain circumstances, etc.;
  • • reproduce the "YC.MARKET" System beyond its functional purpose: carry out public display and public demonstration of the "YC.MARKET" System for educational, demonstration or presentation purposes;
  • • contact the technical support service if the Licensee has any questions regarding the use of the "YC.MARKET" System (including obstacles to or lack of access). The technical support service may be contacted using the feedback form provided in the "YC.MARKET" System and/or by sending a request to the Licensor’s email address: [email protected]. In order to identify the Licensee, the Licensor may request its login, name (first name and surname) and, if necessary, other information confirming the right of access to the "YC.MARKET" System.

The Licensee is obliged to:

  • • comply with the terms of the Agreement for the right of software use (hereinafter — the "Agreement"), and the prohibitions and restrictions provided for therein, and to comply with the terms of the licenses granted and these Terms of Use of the information and analytical system for the search and processing of information in the field of business and other types of activity "YOUCONTROL.MARKET" (hereinafter referred to as the "Terms");
  • • when forming and/or distributing information in the section of the "YC.MARKET" System intended for the distribution of information by users of the "YC.MARKET" System, comply with the requirements of current legislation and generally recognized ethical norms;
  • • provide valid, accurate and complete information about itself and other information necessary for fulfilling the terms of the Agreement;
  • • ensure the preservation of information required for authorization in the "YC.MARKET" System (logins, access passwords, etc.);
  • • immediately notify the Licensor of any infringement by third parties of the Licensor’s rights in respect of the "YC.MARKET" System (if the Licensee is aware of such infringements), as well as assist the Licensor in prompt termination of such infringements and fixation of evidence of their existence;
  • • when distributing information obtained from the "YC.MARKET" System to third parties, inform them that such information is exclusively recommendatory in nature and cannot substitute for any expert opinions or existing official data and/or establish any facts or circumstances of legal significance, that the use of data from the "YC.MARKET" System for making managerial, financial, organizational or any other decisions, taking any actions (or refraining from taking any actions) is solely at the discretion of such persons, and that the Licensor shall not be liable for the consequences thereof.

The Licensee is prohibited from:

  • • decompiling the databases available in the "YC.MARKET" System for the purpose of transferring information to other information retrieval systems or for any other purposes;
  • • using images of the interface of the "YC.MARKET" System in its own information products without the Licensor’s permission;
  • • providing access to any third parties (except for employees and/or authorized representatives of the Licensee) to the "YC.MARKET" System;
  • • placing analytical data from the "YC.MARKET" System in any other information retrieval systems, computer programs, electronic and/or printed publications without the Licensor’s permission, as well as distributing such data for consideration to any third parties, including via the Internet;
  • • forming and/or distributing false information and information containing obscene, rude or offensive language in the section of the "YC.MARKET" System intended for the distribution of information by users of the "YC.MARKET" System;
  • • interfering with the operation of the "YC.MARKET" System or attempting to access it using methods that do not conform to the forms of search queries and information retrieval specified therein (the web-based software interface, API configurations, etc.), including by using other software;
  • • issuing permits (licenses, sublicenses) to any third parties for the right to use the "YC.MARKET" System;
  • • when using the "YC.MARKET" System, including when performing search queries or entering data into the "YC.MARKET" System, using information obtained unlawfully, restricted-access information without proper legal grounds, or any other information (including secret, official or confidential information, personal data, etc.) that is subject to restrictions on its collection, use or dissemination;
  • • using the "YC.MARKET" System contrary to these Terms and for any purpose contrary to the legislation of Ukraine.

The Licensor reserves the right to moderate and/or delete information generated and/or distributed by the user in the section of the "YC.MARKET" System intended for the distribution of information by users of the "YC.MARKET" System, if the formation and distribution of such information is contrary to the provisions of these Terms and/or current legislation.

The Licensor does not provide recommendations or advice regarding the Licensee’s actions, conduct investigations, checks or expert examinations, establish legally significant facts or circumstances, or collect or verify evidence. The analytical information in the "YC.MARKET" System is generated based on the analysis of open sources of information and reflects probable connections and circumstances rather than established facts. The Licensee shall independently assess and analyze any information obtained through the "YC.MARKET" System.

The Licensor does not control and does not direct the actions of users when forming the information that is distributed by them in the "YC.MARKET" System. The formation of the content and distribution of the specified information is carried out by the users of the "YC.MARKET" System exclusively at their own discretion.

The Licensee must refrain from using the "YC.MARKET" System in any manner contrary to the terms of the Agreement, the terms of the licenses granted and these Terms.

In the event of the Licensee’s violation of any prohibitions established by the Agreement and/or these Terms, or failure to comply with the conditions and/or deadlines for payment of the license fee, the license granted to the Licensee to use the "YC.MARKET" System may be terminated.
